PayPool policies.

These policies explain how PayPool works, what PayPool is responsible for, what Square or Stripe handles, and what you agree to when using PayPool.

PayPool Terms of Service

Agreement to these Terms

These Terms govern access to and use of PayPool, including the PayPool website, dashboard, customer onboarding tools, billing setup services, recurring billing setup services, customer payment setup services, support services, and related services provided by Realtor Recon LLC, doing business as PayPool. By creating an account, submitting a setup packet, signing up for PayPool, paying for PayPool, using PayPool, or clicking to accept these Terms, you agree to be bound by these Terms. If you use PayPool on behalf of a business, you represent that you have authority to bind that business.

What PayPool is

PayPool is a managed billing setup and recurring payment support service for pool service companies. PayPool helps businesses set up, organize, and manage recurring customer billing using third-party payment processors, including Square and/or Stripe. PayPool may provide customer onboarding forms, customer billing setup assistance, recurring billing setup assistance, payment link setup, invoice or subscription setup, billing dashboard access, payment processor setup assistance, administrative support, and ongoing support related to recurring billing workflows.

PayPool is not the payment processor

PayPool is not a bank, payment processor, money transmitter, lender, escrow service, accounting firm, tax advisor, law firm, or financial institution. PayPool does not process payments directly. PayPool does not approve, decline, settle, hold, transmit, custody, or release customer funds. Payment processing is performed by the applicable third-party payment processor, including Square, Stripe, or another approved processor.

Third-party payment processors

By using PayPool, you acknowledge that Square, Stripe, and other payment processors are independent third-party services. Any payments made by your customers are processed by the applicable third-party processor, not by PayPool. You are responsible for reviewing, accepting, and complying with all applicable processor terms, agreements, policies, fee schedules, risk rules, underwriting requirements, identity verification requirements, dispute rules, refund rules, chargeback rules, account requirements, and processor requirements.

Square and Stripe terms

If Square is used, your use of Square is subject to Square’s applicable terms, including Square’s General Terms of Service, Payment Terms, Privacy Notice, pricing, and any additional Square terms that apply. If Stripe is used, your use of Stripe is subject to Stripe’s applicable terms, including the Stripe Services Agreement, Stripe Privacy Policy, pricing, Connected Account terms if applicable, and any additional Stripe terms that apply. Square and Stripe may update their terms, fees, rules, and policies at any time.

Your payment processor account

Depending on your setup, PayPool may assist with creating, configuring, organizing, or managing a Square or Stripe account for your business. You are responsible for providing accurate and complete information required to create, verify, maintain, and operate the processor account, including business information, tax information, EIN, address, owner information, bank account information, identity verification information, and customer billing information.

Processor decisions, holds, reserves, disputes, and fees

You are responsible for all payment processor fees, chargebacks, refunds, reversals, disputes, reserves, holds, processor account reviews, suspensions, terminations, fraud reviews, card network rules, ACH rules, bank rules, and customer payment failures. PayPool does not control and is not responsible for processor underwriting decisions, risk reviews, account approvals, account closures, pricing changes, payout delays, holds, reserves, disputes, chargebacks, refunds, reversals, or failed payments.

Limited administrative authorization

By using PayPool, you authorize PayPool to act as a limited administrative service provider for the purpose of helping set up, configure, support, and manage your recurring billing system. This may include creating or assisting with processor account setup, configuring payment settings, creating customers, creating payment links, creating recurring billing items, invoices, or subscriptions, viewing customer billing records, viewing payment statuses, assisting with failed-payment workflows, and communicating with you about setup, verification, and processor requirements.

No ownership of your business or funds

PayPool does not become the owner of your business, your customers, your receivables, your funds, or your payment processor account solely by providing setup or administrative services. You remain responsible for reviewing all account information, billing settings, payment amounts, customer authorizations, processor activity, payouts, fees, disputes, and account notices.

PayPool service fees

Unless otherwise agreed in writing, the PayPool service fee is $199 per month. This PayPool service fee is separate from and in addition to any Square, Stripe, bank, card network, ACH, chargeback, refund, dispute, hardware, software, tax, or other third-party fees. PayPool’s service fee does not include payment processor fees. You authorize PayPool or its payment provider to charge your selected payment method for PayPool’s monthly service fee and any other amounts you agree to pay PayPool.

Suspension for failed PayPool subscription payments

If your PayPool subscription payment fails, PayPool may suspend or restrict access to your PayPool dashboard, customer billing tools, setup support, payment links, administrative support, and related services until payment is brought current.

Customer payment authorizations

You are responsible for obtaining proper authorization from your customers before charging them, enrolling them in recurring billing, saving a card on file, sending payment links, setting up ACH payments, or using any automatic payment method. You are responsible for ensuring that your customer billing practices comply with applicable laws, card network rules, ACH rules, Square rules, Stripe rules, consumer protection laws, cancellation laws, refund laws, notice requirements, and recurring billing requirements.

No guarantee of payment

PayPool does not guarantee that your customers will pay, that payments will succeed, that recurring billing will not fail, that payment methods will remain valid, that funds will settle, or that Square or Stripe will approve, maintain, or continue your account. Payments may fail for many reasons, including insufficient funds, expired cards, blocked cards, bank declines, ACH failures, customer disputes, processor risk reviews, processor holds, card network rules, incorrect customer information, customer cancellation, or technical issues.

Client responsibilities

You agree to provide accurate business, owner, tax, bank, contact, and customer billing information; keep your contact information current; review all PayPool, Square, Stripe, and processor account activity; review fees, payouts, disputes, refunds, and customer payments; obtain customer authorization before charging customers; comply with applicable laws and processor rules; respond promptly to setup and verification requests; and notify PayPool immediately of unauthorized access, incorrect billing settings, disputes, or suspected errors.

Prohibited uses

You may not use PayPool for illegal activity, fraudulent activity, unauthorized charges, charging customers without authorization, misrepresenting payment terms, processing payments for goods or services not actually provided, evading processor or legal requirements, or any business or activity prohibited by Square, Stripe, another processor, or applicable law. PayPool may suspend or terminate access if we believe your use creates legal, financial, reputational, processor, customer, or operational risk.

Cancellation of PayPool services

You may cancel PayPool services at any time by emailing PayPool at support@paypool.io or by opening your Square invoice email and selecting the cancellation option available through Square. Cancellation of PayPool does not automatically cancel any obligations you may have to Square, Stripe, your customers, your bank, card networks, ACH providers, or any other third party.

30-day processor access transfer request period

If you cancel PayPool services, you have 30 calendar days from the cancellation date to email support@paypool.io and request transfer or relinquishment of administrative access to the applicable Square or Stripe account. You are responsible for responding promptly to PayPool’s transfer instructions and providing any information reasonably required to complete transfer, relinquishment, ownership update, admin update, login update, bank update, identity verification, or account transition steps required by Square, Stripe, or PayPool.

Failure to request transfer after cancellation

If you do not contact PayPool at support@paypool.io within 30 calendar days after cancellation to request transfer or relinquishment of processor access, or if you do not respond to PayPool’s reasonable transfer instructions within that period, PayPool may cancel, close, deactivate, disable, restrict, or terminate the Square or Stripe account or related billing setup to the extent permitted by Square, Stripe, and applicable law. PayPool is not responsible for loss, interruption, failed payment, billing disruption, lost authorization, lost access, payout delay, processor review, processor closure, account deactivation, or data loss caused by your failure to request transfer or respond within the 30-day period.

Data and records after cancellation

After cancellation, PayPool may retain certain records as needed for business records, legal compliance, dispute defense, fraud prevention, tax purposes, processor inquiries, and internal operations. PayPool is not required to maintain active dashboard access, payment links, customer records, billing automations, recurring payment workflows, or processor administrative support after cancellation.

Service availability

PayPool may experience interruptions, delays, errors, bugs, outages, maintenance periods, third-party failures, processor outages, hosting outages, internet failures, database issues, or other service interruptions. PayPool does not guarantee uninterrupted or error-free service.

No legal, tax, accounting, or financial advice

PayPool provides billing setup and administrative support services. PayPool does not provide legal advice, tax advice, accounting advice, financial advice, investment advice, banking advice, or compliance advice. You are responsible for consulting your own attorney, accountant, tax advisor, financial advisor, or compliance advisor as needed.

Intellectual property and confidentiality

PayPool owns the PayPool brand, website, dashboard, software, workflows, templates, systems, documentation, designs, text, graphics, logos, and other materials, except for materials owned by third parties or information you provide. You may not copy, resell, reverse engineer, reproduce, distribute, or create derivative works from PayPool without written permission. You also agree not to disclose PayPool’s non-public systems, workflows, internal processes, pricing exceptions, software, templates, or confidential business information without written permission.

Limitation of liability

To the maximum extent permitted by law, PayPool is not liable for indirect, incidental, special, consequential, punitive, exemplary, or lost-profit damages, including lost revenue, lost business, lost customers, lost data, failed payments, processor holds, reserves, suspensions, terminations, chargebacks, refunds, reversals, disputes, bank actions, customer claims, or business interruption. To the maximum extent permitted by law, PayPool’s total liability for any claim related to PayPool, these Terms, or the services will not exceed the amount you paid to PayPool for the one month immediately preceding the event giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless PayPool, its owners, employees, contractors, vendors, agents, and affiliates from and against claims, losses, damages, liabilities, costs, fees, penalties, disputes, chargebacks, refunds, reversals, customer complaints, processor claims, bank claims, regulatory claims, attorney’s fees, and expenses arising out of or related to your business, customers, billing practices, failure to obtain customer authorization, processor use, violation of processor terms, violation of these Terms, violation of law, inaccurate information you provide, payment disputes, processor actions, and customer claims related to payments, billing, cancellations, or services.

Termination and changes

PayPool may suspend or terminate your access to PayPool if you fail to pay PayPool fees, violate these Terms, create legal, processor, financial, customer, or operational risk, use PayPool for prohibited activity, fail to provide required setup or verification information, if Square or Stripe suspends, restricts, or terminates your processor account, or if PayPool determines that continued service is not commercially, legally, or operationally reasonable. PayPool may update these Terms from time to time. Your continued use of PayPool after updated Terms are posted or provided means you accept the updated Terms.

Governing law and contact

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. For support, account, cancellation, billing setup, processor transfer, policy, or privacy questions, contact PayPool at support@paypool.io.

PayPool Privacy Policy

Overview

This Privacy Policy explains how Realtor Recon LLC, doing business as PayPool, collects, uses, shares, and protects information when you use PayPool. By using PayPool, you agree to this Privacy Policy.

Information we collect

We may collect information you provide directly to us, including business name, owner name, contact name, email address, phone number, business address, service address, EIN or tax-related business information, business type, bank setup information needed for processor onboarding, customer names, customer emails, customer phone numbers, customer addresses, customer service notes, customer billing amounts, billing frequency, billing start dates, payment status, payment processor account information, setup packet information, support messages, emails, texts, calls, and other information you submit to PayPool.

Technical and usage information

We may collect technical and usage information, including IP address, browser type, device information, login information, dashboard activity, pages viewed, date and time of access, error logs, system activity, cookies, session storage, analytics data, or similar tracking technologies.

Payment information

PayPool does not intentionally store full credit card numbers or full bank account login credentials. Payment method information is generally collected and processed by third-party payment processors such as Square or Stripe. PayPool may have access to limited payment-related information through Square, Stripe, or PayPool systems, including customer names, payment status, transaction status, last four digits, payment method type, invoice status, subscription status, payout status, chargeback status, refund status, or similar processor-provided information.

How we use information

PayPool may use information to provide PayPool services, set up your billing system, help create or configure Square or Stripe accounts, create customer billing records, create recurring billing workflows, create payment links, invoices, or subscriptions, provide dashboard access, provide support, communicate with you, send setup instructions, send billing and account notices, process PayPool subscription payments, troubleshoot technical issues, monitor system performance, prevent fraud or misuse, enforce agreements, maintain records, respond to legal or processor requests, and improve PayPool.

How we share information

We may share information with Square, Stripe, other processors used to provide PayPool, hosting providers, database providers, email providers, SMS providers, software vendors, customer support tools, legal, accounting, or compliance advisors, government authorities if required by law, and buyers, successors, or assignees in connection with a merger, acquisition, sale, or transfer of PayPool assets.

Customer information you provide

You are responsible for having the right to provide customer information to PayPool. You represent that you have provided all notices and obtained all consents required to provide customer information to PayPool, Square, Stripe, or any other payment processor. You are responsible for your own privacy notices, customer communications, recurring billing authorizations, cancellation policies, and legal obligations to your customers.

Third-party processors

PayPool relies on third-party services, including Square and Stripe. Your use of Square or Stripe is governed by their own privacy policies and terms. PayPool is not responsible for the privacy practices, data practices, security practices, fees, rules, or decisions of Square, Stripe, or other third-party services.

Security and retention

PayPool uses reasonable administrative, technical, and organizational measures designed to protect information, but no system can be guaranteed to be completely secure. PayPool may retain information for as long as reasonably necessary to provide services, maintain business records, comply with legal obligations, resolve disputes, respond to chargebacks or processor inquiries, prevent fraud, enforce agreements, support account transfer or cancellation, and maintain tax, accounting, and operational records.

Access, correction, deletion, cookies, and children

You may contact PayPool to request access to, correction of, or deletion of certain information. PayPool may deny or limit requests when retention is required or permitted for legal, tax, compliance, fraud-prevention, dispute, security, processor, or legitimate business purposes. PayPool may use cookies, session storage, analytics tools, log files, and similar technologies to operate the website, maintain login sessions, improve performance, troubleshoot issues, and understand usage. PayPool is intended for business use only and is not directed to children.

Changes and contact

PayPool may update this Privacy Policy from time to time. Updated versions will be posted on PayPool’s website or otherwise made available. Your continued use of PayPool after an updated Privacy Policy is posted or provided means you accept the updated Privacy Policy. For privacy, support, account, cancellation, billing setup, processor transfer, and policy questions, contact PayPool at support@paypool.io.

PayPool User Agreement and Billing Setup Authorization

Authorization to set up billing system

You authorize PayPool to assist with setup, configuration, organization, and administrative management of your customer billing system using Square, Stripe, or another approved third-party payment processor. This authorization includes permission for PayPool to take reasonable actions necessary to provide the service, including creating or helping create a Square or Stripe account, entering business setup information provided by you, configuring payment settings, creating customer records, creating service items, creating pricing items, creating payment links, creating invoices, creating recurring billing schedules, creating subscriptions, organizing customer billing information, viewing transaction status, viewing subscription or invoice status, assisting with customer billing setup, assisting with failed-payment workflows, and providing ongoing administrative billing support.

Payment processor acknowledgment

You understand and agree that PayPool is not the payment processor. Payments are processed by Square, Stripe, or another third-party payment processor. Square or Stripe may approve or deny your account, require identity or business verification, require bank verification, hold or reserve funds, delay payouts, reverse or withhold funds, suspend or terminate accounts, and change pricing, fees, terms, or policies. PayPool does not control processor decisions.

Agreement to processor terms and fees

By accepting this User Agreement, you agree that your use of Square or Stripe is subject to that processor’s own terms, user agreements, payment terms, privacy policies, pricing, and rules. PayPool’s monthly service fee does not include Square, Stripe, card network, ACH, bank, dispute, chargeback, refund, reversal, hardware, or processor fees. You are responsible for reviewing and complying with current processor terms and fees. Square and Stripe may change fees at any time.

Client information

You agree to provide accurate, complete, and current information, including legal business name, DBA if applicable, owner information, EIN or tax information, business address, contact information, bank information, customer billing information, customer payment amounts, customer billing frequency, customer start dates, and any other information required for setup or processing. PayPool may rely on the information you provide and is not responsible for errors caused by inaccurate, incomplete, outdated, or misleading information.

Customer authorization responsibility

You are responsible for obtaining authorization from your customers before charging them or enrolling them in recurring billing. You are responsible for explaining billing amounts, billing frequency, payment dates, cancellation policies, refund policies, and payment terms to your customers. You are responsible for all customer disputes, chargebacks, refunds, reversals, complaints, cancellations, failed payments, and claims.

No funds held by PayPool

PayPool does not hold your customer funds. Customer payments are processed through Square, Stripe, or another third-party processor. Funds are deposited according to the processor’s rules, payout schedule, risk policies, bank requirements, and account status.

Cancellation and 30-day transfer request period

You may cancel PayPool services at any time by emailing PayPool at support@paypool.io or by opening your Square invoice email and selecting the cancellation option available through Square. If you cancel PayPool services, you have 30 calendar days from the cancellation date to email support@paypool.io and request transfer or relinquishment of administrative access to your Square or Stripe account. You must respond to PayPool’s transfer instructions and complete any required processor steps within the 30-day period. If you do not contact PayPool within that period, or if you do not respond to reasonable transfer instructions during that period, PayPool may cancel, close, deactivate, disable, restrict, or terminate the applicable Square or Stripe account or related billing setup to the extent permitted by Square, Stripe, and applicable law.

Acknowledgment of risk

You acknowledge that recurring billing and payment processing involve risk, including failed payments, declined cards, expired cards, ACH returns, customer disputes, chargebacks, refunds, reversals, processor holds, reserves, reviews, suspensions, closures, delayed payouts, customer cancellations, incorrect customer information, and incorrect billing settings. You accept these risks and agree that PayPool is not responsible for losses caused by these risks unless directly caused by PayPool’s intentional misconduct.

Acceptance

By checking the agreement box, creating an account, submitting a setup packet, paying for PayPool, or using PayPool, you confirm that you have read, understand, and agree to this User Agreement, PayPool’s Terms of Service, PayPool’s Privacy Policy, the applicable Square or Stripe terms, the applicable Square or Stripe fees, and PayPool’s cancellation and processor transfer policy.
